Welcome to the website of Timber Living . By using our website and/or placing an order for one of our log cabins, timber homes or garden cabins in Ireland you accept and agree to be bound by these Terms & Conditions. If you do not agree with these T&Cs, you should not use the Site or place an order.

1. General

1.1 These T&Cs apply to all orders made via this Site by customers in Ireland.
1.2 We reserve the right to amend or update these T&Cs at any time. The version posted on the Site will always be the current version.
1.3 These T&Cs, together with our Privacy Policy and Cookies Policy, govern your use of our Site and the purchase of our Products in Ireland.
1.4 Our Site is intended for use within the Republic of Ireland. All Products are sold and delivered to locations in Ireland unless otherwise stated.

2. Quotations, Orders & Contract Formation

2.1 All Product descriptions, illustrations and pricing on the Site are for Irish customers and are subject to change without notice. They are invitations to treat, not binding offers.
2.2 When you place an order via the Site, you are offering to purchase a Product subject to these T&Cs.
2.3 Our acceptance of your order will occur when we send you a written order-confirmation email. At that point a contract is formed.
2.4 We may decline to accept an order for any reason, including but not limited to availability, errors in pricing or Product description, or access to your address for delivery in Ireland.

3. Pricing & Payment

3.1 All prices shown on the Site include VAT and standard delivery within Ireland (if applicable).
3.2 Payment terms: typically, a deposit is required at contract formation (for example 30 % or as specified) with the balance due prior to delivery/installation.
3.3 If you fail to make a required payment, we may treat the order as cancelled and retain your deposit as compensation for our costs.
3.4 We accept payment by [specify methods: bank transfer, credit/debit card, other].
3.5 The Products remain our property until full payment is received.

4. Delivery, Installation & Site Preparation

4.1 Delivery estimates are given for guidance only. We will aim to meet estimated delivery times but cannot guarantee them.
4.2 You are responsible for ensuring the installation site is ready and accessible in Ireland: correct base/foundation, level ground, soil conditions, drainage, vegetation cleared, access for delivery vehicles, etc.
4.3 If the site is not prepared in accordance with the requirements and delivery must be delayed or cancelled, we may charge you extra costs or deduct delivery cost from deposit.
4.4 On delivery/installation, you must inspect the Product and notify us of any visible defects within 48 hours.
4.5 We recommend you obtain any required planning permissions, building control approvals, Local Authority permits or other third-party approvals in Ireland. We provide guidance but the responsibility remains yours.

5. Ownership, Risk & Title

5.1 Risk in the Products passes to you when the Products are delivered on site.
5.2 Title remains with us until full and final payment has been made by you. Until then you must treat the Products as our property and not dispose or encumber them.

6. Warranty, Maintenance & Longevity

6.1 We warrant that the Products will be fit for purpose, free from material defects in workmanship and materials, for a period of 10 years from the date of practical completion, subject to proper maintenance and use.
6.2 This warranty does not cover defects caused by misuse, neglect, unauthorised alterations, failure to maintain the timber in an Irish climate, or third-party works not carried out by us.
6.3 You must follow all maintenance instructions (including sealing, treating timber, checking drainage, correct insulation) to keep the warranty in force.
6.4 If you relocate the cabin without our written approval, warranty is void.

7. Your Obligations

7.1 You must ensure you comply with all relevant Irish laws, regulations and Local Authority requirements (planning, building control, health & safety) for the site and installation.
7.2 You must not use the Site or Products for illegal or immoral purposes.
7.3 You must provide accurate, up-to-date information when ordering.
7.4 You must allow us, our agents or contractors access to the site for delivery/installation at agreed times.
7.5 You must maintain the Product according to our instructions and ensure appropriate insurance is in place for your property in Ireland.

8. Planning Permission & Approvals

8.1 You acknowledge that in Ireland planning permission may be required for certain structures, especially larger log cabins, residential use or building extensions. For example, a common rule: buildings under 25 sqm and less than 3.9 m high may not need permission.
8.2 Whereas we can provide general guidance and exemplars, it is your responsibility to check with your local authority in Ireland and obtain any required permissions.
8.3 We will not be held liable if planning permission is refused, delayed or conditions are imposed.
8.4 Any changes required by local authority, or any removal/alteration of the Product, will be at your cost.

9. Limitation of Liability

9.1 Nothing in these T&Cs shall limit or exclude our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • any other liability which cannot by law be excluded or limited in Ireland.
    9.2 Subject to 9.1, our total liability under or in connection with any contract shall be limited to the purchase price you paid for the Product.
    9.3 We are not liable for indirect or consequential losses (e.g., loss of profit, loss of business)

10. Intellectual Property

10.1 All content on the Site (text, graphics, logos, images, designs) is our property or licensed to us. Use of that content without permission is prohibited.
10.2 You may download or print for your personal, non-commercial use, but you must retain all copyright and other proprietary notices.

11. Website Use & User-Generated Content

11.1 You agree to use the Site in a lawful manner and not to upload or transmit any harmful, offensive or infringing content.
11.2 We do not guarantee that the Site will be uninterrupted or error-free.
11.3 We may suspend or terminate access to the Site at any time without notice, particularly if you breach these T&Cs.

12. Cookies, Privacy & GDPR

12.1 Our use of cookies and handling of your personal data is governed by our Cookies Policy and Privacy Policy.
12.2 You consent to processing of your personal data as described in the Privacy Policy (GDPR compliance for Ireland/EU).
12.3 If you register, place an order or otherwise submit personal data, you agree to us storing and using that data for the purposes of fulfilling your order, marketing (if opted in), and internal record-keeping.

13. Force Majeure

13.1 We will not be liable for any failure or delay in performance of our obligations where caused by circumstances beyond our reasonable control (e.g., extreme weather in Ireland, strikes, supply chain issues, government regulation).
13.2 If a force majeure event continues for more than 60 days, either party may terminate the contract by giving written notice.

14. Returns, Cancellations & Refunds

14.1 Due to the bespoke nature of log cabins, returns are not normally accepted once manufacturing or installation has commenced.
14.2 If you cancel before manufacturing, we may retain a cancellation fee or deposit to cover work done.
14.3 Refunds (if any) will be processed to your original payment method, minus any reasonable costs incurred.

15. Governing Law & Jurisdiction

15.1 These T&Cs and any contract formed under them are governed by the laws of the Republic of Ireland.
15.2 You agree to submit to the non-exclusive jurisdiction of the Irish courts in respect of any dispute arising under or in connection with these T&Cs.

16. Severability & Assignment

16.1 If any clause of these T&Cs is found by a court of competent jurisdiction in Ireland to be invalid or unenforceable, that clause will be struck out or modified as necessary, but the remaining clauses shall remain in full force and effect.
16.2 We may assign our rights under any contract to a third party, provided this does not adversely affect your rights. You may not assign your rights without our prior written consent.
